And, on the other hand, the natural person,
hereinafter User, who accesses the page to find out and contract the services
offered through the Website. The User declares that he is of legal age (over 18
years old) and has the necessary legal capacity to acquire the services offered
through the Website and to use it according to the general conditions detailed
below, which he declares to understand and expressly accept entity. In case of
hiring by a minor, travel2scape will not be responsible in any case, and the
minor, parents or guardians will bear the expenses that this may cause.
GENERAL CONDITIONS
ACCESS TO THE WEBSITE
The screens of the Website support the
following browsers: Chrome, Firefox, Internet Explorer 10 and 11, Safari and
Opera. travel2scape is not responsible for the results obtained using a
different browser or operating system.
Users who access the Website through devices
that have reduced format screens, declare that they have previously accessed
through a device with one of the browsers indicated in the previous paragraph
and have consulted the conditions of the website and all the notices made
available to the recipient without any restriction due to the characteristics
of the device with which the reservation is formalized.
The User can freely access the Website or, if
he prefers, he can register, in which case he must enter his e-mail and a
password chosen by himself. Once registered you will have access to your
profile and you will be able to consult your overdue reservations, the current
ones, as well as consult or modify the available information to expedite and
facilitate your upcoming reservations.
The User must ensure that the password is not
used by unauthorized third parties. In this sense, travel2scape will not assume
any responsibility arising from the use of the Website with the unauthorized
use of said password.
The User declares that all the information
provided by him when registering and making reservations is true and complete,
pledging to keep it up to date in the successive uses he may make of the
services offered on the website.
CONTENT AND RESPONSIBILITY
Travel2scape operates the Website and, in
particular, offers and, where appropriate, supplies the contents, products and
services to the User visiting the Website in the name and on behalf of renowned
tour operators. In this sense, travel2scape has limited itself to including the
service in the WEBSITE. Unless explicitly stated in this way, in no case can it
be understood that travel2scape directly offers flights, car rental services,
combined trips, hotel and bus reservations and tourist services or similar.
The purchase of products/services through the
Website means the acceptance by the User of (i) these general conditions, (ii)
the particular conditions of application to the specific type of
product/service to be contracted and (iii) the conditions of the supplier of
the product/service.
In particular, in the case of low-cost
airlines, the use by the customer of the WEBSITE for the location of flights
for the purposes of their contracting implies the direct submission of the
customer to the general conditions of said airlines and to the general
conditions of the websites of each of them, including those corresponding to
the protection of personal data.
The User agrees to accept and respect the terms
and conditions of purchase established by the provider with which he formalizes
the reservation. These conditions may include the payment of any accrued
amounts and compliance with any rules and restrictions on the availability of
rates, products or services.
The User must know that the contracting of
package trips is governed by the provisions of Book IV of Royal Legislative
Decree 1/2007, of November 16, which approves the consolidated text of the
General Law for the Defense of Consumers and Users and other complementary laws
and the specific condition agreed with the User depending on the organizer /
wholesaler who organizes the combined trip, with travel2scape being the retail
travel.
The suppliers of products or services and the
organizers/wholesalers who organize the combined trip, each within the scope of
their respective obligations, will be responsible to the User for the
fulfillment of the obligations arising from the regulations in force and the
conditions of sale of each of the products and services or combined trips that
are contracted, without travel2scape assuming any obligation or responsibility
with respect to those products or services that you do not provide directly.
The traveler is responsible for complying with
government requirements for exit, entry and other documentation. This
information can be found on the website of the Spanish Ministry of Foreign
Affairs (
www.exteriores.gob.es
). travel2scape may incorporate
additional specific conditions that will be made appear on the website.
PURCHASE PROCESS
On the website, the reservation can be made in
Spanish. Most of the fields are free, so that the Website does not have the
means to identify and correct errors in the entry of the data, for this reason
it will be the responsibility of the USER any error made when entering such
data.
The document in which the contract is
formalized by means of which the customer acquires any tourist product or
service through the Website will be sent to the User by email. In this email,
you will be given the information regarding the contracted products and/or
services, your locator number, all the indications related to the payment
method, cancellation conditions, other useful information and, where
appropriate, the sending of the documentation of your trip. Likewise, the
document will be archived by travel2scape and the User will be able to access
it at any time through the "Login (My Reservations)" section of the
Website, which appears at the top right of it, entering their email address and
password.
The purchase of any product will only be
effective at the time when travel2scape makes the charge validly depending on
the chosen payment method and may until then be canceled by travel2scape.
The available means of payment are:
• PAYMENT BY CREDIT OR DEBIT CARD. On
debit cards the amount charged is automatically withdrawn from the associated
account, on credit cards the User can have money without having funds in the
associated account, and the amount is normally charged at the beginning of the
month following the purchase.
• ORDINARY BANK TRANSFER. Once the
reservation has been made on our website, you must make a transfer within the
next 24 working hours for the amount accepted. The concept of the transfer must
include the locator that we will provide at the end of this reservation. You
need to send us a proof of the transfer to the following email:

• PAYPAL. We connect with PayPal where
you must log in with your user to proceed with the payment. We recommend paying
with PayPal because it is one of the most secure forms of payment.
Not all these payment options are always
activated, it will depend on the type of product and the advance with which you
make the reservation.
The fact of requesting a reservation implies a
commitment on the part of the customer to authorize the charge for the full
amount of the product, service or combined trip contracted.
The prices indicated online include airport
taxes. However, they do not include local rates - which are paid at hotels - or
departure fees from the country - which are paid at airports.
RIGHT
OF WITHDRAWAL
It is the ability of the user to cancel a
contract in certain cases without having to justify his decision or assume any
penalty.
Pursuant to article 103 paragraph l) of Royal
Legislative Decree 1/2007, of November 16, which approves the consolidated text
of the General Law for the Defense of Consumers and Users and other
complementary laws, the right of withdrawal will not apply to contracts that
refer to the provision of accommodation services for purposes other than
housing, transport of goods, rental of vehicles, food or services related to
recreational activities,
Regarding the transport of people, according to
article 93 k) of Royal Legislative Decree 1/2007 approving the Consolidated
Text of the General Law for the Defense of Consumers and Users, the regulation
of distance sales (with the exception of article 98.2) does not apply to
passenger transport service contracts. Therefore, the right of withdrawal does
not apply to the reservation of passenger transport services. Thus, in the
event that the USER expresses his willingness to cancel the contracted tickets,
the cancellation conditions of the company in question will apply to him.
With regard to package trips, article 160 of
the same legal text provides that the User may at all times cancel the
requested or contracted services, having the right to the refund of the amounts
he had paid, but must compensate the organizer or the retailer in the following
amounts, unless such resolution takes place due to force majeure:
• You will pay the management fees,
cancellation fees, if any, and a penalty consisting of 5 percent of the total
amount of the trip, if the cancellation occurs more than ten and less than
fifteen days before the date of the start of the trip; 15 percent between days
three and ten, and 25 percent within the forty-eight hours prior to departure.
• If he does not show up on departure, the
consumer and user is obliged to pay the total amount of the trip, paying, where
appropriate, the outstanding amounts unless otherwise agreed between the
parties.
• In the event that the package trip is subject
to special economic contracting conditions, such as chartering of aircraft,
ships or special fares, the cancellation fees will be established in accordance
with the conditions agreed between the parties.
INDUSTRIAL
AND INTELLECTUAL PROPERTY RIGHTS
The entirety of this Website: text, images,
brands, graphics, logos, buttons, software files, color combinations, as well
as the structure, selection, ordering and presentation of its contents, is the
property of travel2scape and its reproduction, distribution, public
communication and transformation is prohibited. Likewise, the reproduction,
retransmission, copying, transfer or broadcasting, in whole or in part, of the
information contained in these pages, whatever its purpose and the means used
for it, is prohibited.
Users will use the Website solely and
exclusively for private and private use. Users may not copy, reproduce,
transmit or distribute in any way the content of this Website or the services
that can be obtained through it, without the written permission of
travel2scape.
Users will not be able to establish Links to
web pages of the Website without written consent
from travel2scape.
Travel2scape will not be responsible, directly
or subsidiarily for:
• The violation by the User of the intellectual
and industrial property rights, the rights to honor, personal and family
privacy and the image of people (photographs), property rights and any other
nature belonging to a third party as a result of the transmission,
dissemination, storage, making available, reception, obtaining or access to the
contents.
• The links and hypertext that enable the User
to access benefits and services offered by third parties through the Website,
do not belong to or are under the control of travel2scape; it will not be
responsible for the information contained therein or for any effects that may
arise from such information.
GENERAL
INFORMATION
The portal reserves the right to modify, limit
or cancel the terms and conditions applicable to the aforementioned Website. In
any case, the conditions that were in force when the customer formalized the
reservation will apply, or the subsequent ones if they are more favorable to
the interests of the consumer.
Travel2scape reserves the right to deny or
withdraw access to the Portal and/or the Services, at any moment and without
prior notice to those Users who fail to comply with these General Conditions.
These conditions will be subject to Spanish
legislation. The courts of Las Palmas de Gran Canaria will be competent to hear
any litigation arising from these conditions, except that, according to the
provisions of Royal Legislative Decree 1/2007, of November 16, which approves
the consolidated text of the General Law for the Defense of Consumers and
